BitDive Terms of Service

Welcome to BitDive. These Terms of Service ("Terms") govern your access to and use of the BitDive SaaS platform, the BitDive.io Agent, and any related documentation (collectively, the "Service") provided by the BitDive Team ("BitDive", "we", "us", or "our").

By accessing or using the Service, or by integrating the BitDive Agent into your applications, you agree to be bound by these Terms and our Privacy Policy.

1. Scope of Service​

BitDive provides an AI-native observability and deterministic verification platform for JVM applications. The Service includes:

  • The SaaS Interface: Hosted at bitdive.io for data visualization and analysis.
  • The BitDive Agent: Proprietary bytecode instrumentation technology.
  • The MCP Server: Integration protocols for AI agents (Cursor, Claude, etc.).

2. Professional Use and Accounts​

The Service is intended for professional use by software engineers and organizations. You are responsible for:

  • Maintaining the confidentiality of your API tokens and login credentials.
  • All activity occurring under your account.
  • Ensuring that your use of the Service complies with your internal corporate policies and applicable laws.

3. Service Levels and Enterprise Support​

  • Standard SaaS: The publicly accessible SaaS version is provided "as is" without a formal Service Level Agreement (SLA). We strive for 99.9% availability but do not provide contractual guarantees for free-tier users.
  • Enterprise Upgrade: For organizations requiring 99.99% SLAs, private cloud deployments (On-Premise), priority 24/7 support, and custom Data Processing Agreements (DPA), please contact our Enterprise team at sales@bitdive.io.

4. Data Security and Ownership​

We treat your telemetry data with the highest level of security:

  • Encryption: All data is encrypted in transit using TLS 1.3 and at rest using AES-256.
  • Ownership: You retain full ownership of all data captured by the Agent and stored in the Service.
  • Non-Disclosure: BitDive will not disclose your telemetry or session data to any third party, except as required by law or to provide the Service.

5. Intellectual Property Rights​

The Service, including its architecture, UI/UX, bytecode instrumentation logic, and "Deterministic Replay" algorithms, is the exclusive property of BitDive. We grant you a limited, revocable, non-exclusive license to use the Service and the Agent for your internal business and development purposes.

6. Prohibited Activities​

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the BitDive Agent.
  • Use the Service to build a competing performance monitoring or automated testing product.
  • Bypass or attempt to bypass the Service's security controls or usage limits.

7. Limitation of Liability​

To the maximum extent permitted by law, BitDive and its contributors shall not be liable for any indirect, incidental, or consequential damages (including loss of data or production downtime) arising from the use of the Service. Our total liability for any claim shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

8. Updates to Terms​

We may update these Terms to reflect technical or legal changes. Significant changes will be communicated via our website or email. Continued use of the Service after such updates constitutes acceptance.

9. Governing Law and Jurisdiction​

These Terms are governed by the laws of Georgia. Any disputes shall be resolved exclusively in the courts of Tbilisi, Georgia.
