BitDive Software License Agreement

This BitDive Software License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity, "Licensee") and the BitDive Team ("BitDive") for the use of the BitDive Java Agent software ("Software").

1. Grant of License​

Subject to the terms of this Agreement, BitDive grants you a non-exclusive, non-transferable internal-use license to:

  • Install and use the Software on your servers or development environments.
  • Use the Software solely for the purposes of monitoring, profiling, and creating tests for your Java applications.
  • Reproduce the Software for backup or archival purposes only.

2. Intellectual Property​

The Software is licensed, not sold. BitDive retains all rights, title, and interest in and to the Software, including all copyrights, patents, trade secret rights, and other intellectual property rights. This Agreement does not grant you any rights to trademarks or service marks of BitDive.

3. License Restrictions​

You agree that you will not, and will not permit any third party to:

  • Redistribute: Sell, rent, lease, or sublicense the Software.
  • Reverse Engineer: Decompile, disassemble, or attempt to derive the source code of the Agent.
  • Modify: Create derivative works or modify the bytecode of the Software.
  • Competitive Use: Use the Software to develop a competing product or service in the field of application performance monitoring (APM) or automated testing.

4. No High-Risk Use​

The Software is not designed or intended for use in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of the Software could lead directly to death, personal injury, or severe physical or environmental damage ("High-Risk Activities"). BitDive specifically disclaims any express or implied warranty of fitness for High-Risk Activities.

5. Warranties and Disclaimers​

Standard Disclaimer: The Software is provided "As-Is". BitDive makes no warranties, express or implied, including the implied warranties of merchantability or fitness for a particular purpose. While we strive for high stability, we do not guarantee that the Software will be error-free or that it will not affect the performance of the instrumented application under extreme load.

6. Limitation of Liability​

In no event shall BitDive be liable for any lost profits, lost data, or any special, indirect, or consequential damages arising out of the use or inability to use the Software, even if BitDive has been advised of the possibility of such damages.

7. Termination​

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession.

8. Governing Law​

This Agreement shall be governed by and construed in accordance with the laws of Georgia. Any legal action or proceeding related to this Agreement shall be brought exclusively in the courts of Tbilisi, Georgia.

By downloading, installing, or using the BitDive Agent, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms.
