BitDive.io Agent Proprietary License Agreement

1. License Grant

BitDive.io grants the Licensee a non-exclusive, non-transferable, revocable license to download, install, and use the BitDive.io Agent (“Software”) solely for monitoring and analyzing Java applications. This license is intended for internal use within the Licensee’s organization.

2. Restrictions

The Licensee agrees not to:

• Redistribute the Software to any third party, either in its original form or modified.

• Modify or create derivative works based on the Software.

• Reverse-engineer, decompile, or disassemble the Software.

• Use the Software for commercial purposes, including providing monitoring or analysis as a service to third parties, without express written permission from BitDive.io.

• Transfer or sublicense the Software to any third party.

3. Ownership

BitDive.io retains all rights, title, and interest in and to the Software, including any intellectual property rights. The Licensee acknowledges that no ownership rights are transferred by this agreement.

4. Updates and Support

BitDive.io may, at its discretion, provide updates to the Software. Such updates will be governed by the same terms and conditions as this License. BitDive.io does not guarantee support services under this License.

5. Disclaimer of Warranty

The Software is provided “as-is,” without any warranties, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. BitDive.io makes no representation regarding the suitability of the Software for the Licensee’s needs.

6. Limitation of Liability

BitDive.io shall not be liable for any damages arising from the use or inability to use the Software, including, but not limited to, indirect, incidental, or consequential damages, even if BitDive.io has been advised of the possibility of such damages.

7. Term and Termination

This License is effective until terminated. BitDive.io may terminate this License at any time if the Licensee breaches any terms. Upon termination, the Licensee must destroy all copies of the Software and cease all use.

8. Governing Law

This License shall be governed by and construed in accordance with the laws of [applicable jurisdiction].

9. Entire Agreement

This License constitutes the entire agreement between the parties and supersedes all prior agreements and understandings regarding the Software.
